1. Acceptance of Terms

By accessing or using the website, software applications, chat widgets, administrative dashboards, or API services operated by AI Touch Labs ("Company", "we", "us", or "our"), you ("User", "Client", or "Subscriber") agree to be bound by these Terms & Conditions. If you do not agree to all terms outlined herein, you must immediately cease accessing and using our services.

2. Description of Services

AI Touch Labs provides artificial intelligence-powered business automation tools, including but not limited to:

  • AITouch Chat: Multi-channel 24/7 AI sales receptionist and customer support assistant integrating across Web Widget, WhatsApp, Instagram, Facebook Messenger, TikTok, Telegram, and Google Business Messages.
  • AITouch Review: Automated customer review request and reputation management platform.
  • Custom Software Engineering: Custom AI agent development, mobile application, and web architecture services.

3. Account Registration & Security

To use our services, you must register an account by providing accurate and complete business information. You are solely responsible for safeguarding your login credentials and API keys. Any action performed under your account credentials remains your responsibility.

4. Subscriptions, Payments & Free Trials

Our platform offers tier-based software-as-a-service (SaaS) subscriptions (Monthly, 6-Month, and Annual plans) as well as early-access free trials.

  • Free Trials / Alpha Access: Selected plans may offer a free trial period without requiring initial payment information. During this trial period, full access to platform features is granted subject to rate limits.
  • Paid Plans: Upon subscribing to a paid tier, subscription fees are billed in advance on a recurring cycle. You agree to provide valid payment details upon commercial billing activation.
  • Cancellations & Refunds: Subscriptions may be cancelled at any time from your account dashboard. Monthly recurring fees are non-refundable once billed for the active cycle, except where required by law.

5. Acceptable Use & Social Messaging Compliance

You agree to use AI Touch Labs services strictly for lawful business communications. You explicitly represent and warrant that:

  • You will comply with all third-party platform policies, including the Meta Commercial Terms, WhatsApp Business Policy, Instagram Messaging Policies, and Google API Terms of Service.
  • You will not send unsolicited spam messages, harassment, fraudulent content, or deceptive communications to end customers.
  • You hold valid customer consent (opt-in) before initiating outbound automated messages on channels such as WhatsApp or SMS.

6. AI Content & Technology Disclaimer

Our services leverage state-of-the-art Large Language Models (LLMs) to construct customer support responses. While our AI systems are designed to strictly draw responses from your provided Knowledge Base, AI Touch Labs makes no guarantee that AI outputs will always be error-free or 100% accurate. You maintain full oversight and responsibility to configure human takeover triggers and review AI chat logs.

7. Intellectual Property Rights

All intellectual property rights in the AI Touch Labs platform, code, branding, interfaces, and algorithms belong exclusively to AI Touch Labs. Subscribers retain full ownership of their proprietary knowledge base documents, business data, and customer interaction logs.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AI Touch Labs shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from platform downtime, third-party social media platform API changes, loss of revenue, or service interruptions beyond our reasonable control.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable governing laws. Any dispute arising out of or relating to these terms shall be submitted to confidential arbitration or competent jurisdiction courts.
